
The government is going to form the ‘Bangladesh Building Regulatory Authority’. For this, the ‘Bangladesh Building Regulatory Authority Ordinance, 2026’ has been issued. This authority is being formed as a central regulatory body for approving building designs, ensuring construction standards and implementing safe buildings.
The ordinance was issued by the Legislative and Parliamentary Affairs Division of the Ministry of Law on Wednesday night.
According to the ordinance, the Building Regulatory Authority will ensure transparency, accountability and code compliance in the building construction sector. According to the government, the formation of this new authority will reduce long-standing irregularities and lack of coordination in the building construction sector and create a solid framework for ensuring safe and quality buildings.
One of the main responsibilities of the Building Regulatory Authority will be to establish an effective regulatory framework for building design and construction. The organization will also have the power to issue licenses, register and, if necessary, suspend or cancel licenses through examinations of professionals involved in construction planning, design and implementation.
In addition, a system has been put in place to update the building code in light of modern construction materials and technology and to provide necessary explanations in the application of the code. The ordinance has called for the launch of a technology-based online platform to make the building construction approval process transparent.
At the same time, the authority will be able to recommend to the development authority, city corporation, municipality and other organizations to take action against construction companies and related professionals in case of violation of codes and safety rules. In addition, this organization will be responsible for formulating building construction-related policies, coordinating various government rules and policies, and advising the government on increasing administrative capacity.
The ordinance also states that the authority will also play a role in determining the jurisdiction of the activities of the development authority, BC (Building Construction) Committee, city corporation and municipal building officials.
According to the ordinance, a five-member board of directors will be formed to manage the Building Regulatory Authority. The government will appoint the board members, including a chairman. The board is to include a civil engineer, an architect, an urban and regional planner, a judge or jurist, and an experienced civil service officer.
The Chairman will be the Chief Executive of the Authority. The term of office of the Chairman and members will be three years and no person will be able to serve more than two consecutive terms.
Under this ordinance, the Bangladesh Building Regulatory Authority will act as a regulatory and supervisory body over the building design approval and code compliance activities of the country’s development authorities, BC committees, city corporations and municipalities. The authority has also been given the power to verify design-related information and documents by issuing notices, if necessary.
Provision has been made for the formation of a fund to manage the activities of the authority. Money will be deposited in this fund from various sources including government grants, grants from domestic and foreign donor agencies, fees and charges. The money from the fund will be spent in accordance with the government’s regulations and the surplus money will be saved for future activities.
